Public Offer and Return Policy

This Agreement is a contract of adhesion in accordance with Article 634 of the Civil Code of Ukraine, concluded between the individual entrepreneur «Lozenko Tatiana Vyacheslavivna» (hereinafter referred to as the Publisher or the Seller) and an individual, organisation or legal entity that accepts the terms of this Agreement (hereinafter referred to as the Subscriber or the Buyer).

1. Definition of terms

1.1. The Publisher publishes printed or electronic (in pdf format) periodicals - «I AM SELF MADE Magazine» (hereinafter referred to as the Magazine, the Journal, the Edition, the Publication) or non-periodicals (hereinafter referred to as the Book, the Edition, the Publication) and sells them, including subscriptions, through the website https://iamselfmade.online (hereinafter referred to as the Website).
1.2. The User of the Website (Subscriber) is a person who has filled in personal data on the Website to subscribe/purchase the Publication and receive it in accordance with the terms of this Agreement (hereinafter referred to as the Services).
1.3. A copy of the Journal is a separate issue of the Magazine (in printed or electronic format), which has a serial number according to the publication schedule.
1.4. Subscription to the Magazine is the provision to the Subscriber of the number of copies of the Magazine determined and paid for by him/her at the current price at the time of payment specified on the Website.

2. General provisions

2.1 This Agreement defines the terms of subscription/purchase and delivery of the Edition
2.2 In accordance with Article 642 of the Civil Code of Ukraine, the acceptance of this Agreement is the User's payment for the order on the Website (for a regular subscription or a one-time purchase of the Edition).
2.3 Relations between the Parties shall be governed by this Agreement and the current legislation of Ukraine.
2.4. The Agreement shall be governed by the current legislation of Ukraine. By entering into this Agreement, a Subscriber who is not a citizen of Ukraine undertakes to comply with the provisions of Ukrainian legislation.

3. Subject of the Agreement

3.1 The Publisher shall provide the Subscriber with the Services in accordance with this Agreement, and the Subscriber shall accept and pay for them in accordance with the established terms and conditions.

4. Cost, payment and delivery

4.1 Pricing terms:
4.1.1. The cost of one copy of the Journal for a one-time purchase is UAH 250.00 (including VAT).
4.1.2. The cost of the Publications is indicated in UAH, including delivery within Ukraine.
4.1.3. The Publisher has the right to change the price of the Publications by updating the information on the Website. Previously paid orders shall remain at the old prices.
4.2. Delivery:
4.2.1. The cost of delivery by Ukrposhta or Nova Poshta shall be determined by the carrier's tariffs and shall be paid by the Subscriber upon receipt of the Edition.
4.2.2 Delivery time depends on the chosen method and the region of residence and is approximately 3 to 14 days from the date of payment for the Edition or the date of publication (for subscription issues). The date of going out of print is indicated in the source data or on the Website.
4.2.3 The Edition may change the date of dispatch without notice by publishing updates on the Website.
4.2.4. Delivery is carried out only to settlements accessible for transportation where no active hostilities are taking place.
4.3. Payment methods:
4.3.1 Payment shall be made to the details of Individual Entrepreneur «Lozenko Tatiana Vyacheslavivna» in a convenient way: bank transfer, payment through the bank's cash desk or the WayForPay payment system on the Website.

5. Provision of Services

5.1. The Subscriber places an order through the Website and makes payment.
5.2. The price of the Journal does not include the bank commission, which the Subscriber pays additionally.
5.3. The Journal is considered subscribed/purchased after the funds are credited to the Publisher's account.
5.4. Information about the subscription, as well as the purchased electronic edition of the Journal, is sent to the email specified at the time of payment.
5.5. The service is considered to be provided after the Journal is delivered to the courier service or the electronic version is sent to the email specified by the Buyer.
5.6. In case of non-receipt of the Journal, the Publisher shall re-send it or extend the subscription.
5.7. The Edition shall not be returned, except as provided by law.

6. Rights and obligations of the Parties

6.1. The Subscriber shall have the right to change his/her data, subscribe and cancel the subscription in advance.
6.2. The Publisher has the right to change the terms of the Agreement and terminate it in case of violations by the Subscriber.
6.3. The Subscriber is obliged to use the Publication only for personal purposes and to pay the subscription fee in a timely manner.
6.4. The Publisher shall ensure the quality of the Services and the confidentiality of the Subscriber's data.

7. Responsibility of the Parties

7.1. The Parties shall be liable in accordance with applicable law.
7.2. The Publisher is not responsible for delays in courier services, loss of data due to technical failures or force majeure.
7.3. The Buyer shall be personally liable if he/she transfers the Login and Password to third parties.
7.4. The Publisher shall not be liable for the impossibility of servicing the Subscriber for reasons beyond its control, in particular due to malfunctions of Internet communication lines, malfunctions of equipment or software not owned by the Publisher, as well as security breaches of the Subscriber's equipment or software used to receive the Services, which may result in the loss of confidential data.

8. Dispute resolution

8.1. All disputes shall be resolved through negotiations or in accordance with the current legislation of Ukraine.
8.2. This Agreement and its interpretation shall be governed by the laws of Ukraine. All disputes arising in connection with this Agreement shall be settled in the courts of Ukraine. In matters not regulated by this Agreement, the Parties shall be governed by the applicable laws of Ukraine.

9. Term of the Agreement

9.1. The Agreement shall be valid from the date of its conclusion and until the Parties have fully performed their obligations.

10. Amendments to the Agreement

10.1. The Publisher may change the terms of this Agreement without notice. The updated version comes into force from the moment of publication on the Website.
10.2. The User's consent to the terms of this Agreement after the amendments have been made and published on the Site means the User's consent to the updated terms of the Services provided by the Contractor. If the User does not give such consent, he/she may terminate the provision of the Services by the Contractor in accordance with the procedure established by this Agreement.

11. Force-majeure

11.1. Neither Party shall be liable to the other for any damages or losses caused by untimely performance or non-performance of this Agreement, if such circumstances arose as a result of events beyond the control of the Parties and not due to their negligence. Such circumstances include (but are not limited to) natural disasters, strikes, lockouts, riots, military operations, earthquakes, fires, explosions, etc. However, financial insolvency is not considered a force majeure event. The existence and duration of force majeure must be officially confirmed by a competent state authority in accordance with the applicable laws of Ukraine.

12. Special conditions

12.1. The User confirms the legality of payment for the Services under this Agreement by using (confirming) the Login and Password specified during the registration of the Account/on the Ordering page on the Website. The User acknowledges that all Services paid for using his/her Login and Password are considered to be paid for personally.
12.2 In accordance with Article 32 of the Law of Ukraine «On Ensuring the Functioning of the Ukrainian Language as the State Language», the Law of Ukraine «On Advertising» and other legislative acts, the printed version of the «I AM SELF MADE» magazine is published in Ukrainian and English simultaneously in one copy.
